    <dc:creator>roel</dc:creator><description><![CDATA[WTF-momentje op de vrijdagmiddag dat ik het las: Facebook weigert inzage in persoonsgegevens van hun gebruikers omdat afgifte daarvan hun handelsgeheimen in gevaar zou brengen.


De groep Europe versus Facebook had een campagne opgezet waarbij alle Europese Facebookgebruikers opgeroepen werden om een inzageverzoek te doen onder de privacywet van alle persoonsgegevens die Facebook van ze had. Facebook is verplicht daaraan mee te werken, en biedt daarvoor dit formulier, maar beriep zich tegenover enkele Ierse verzoekers op een uitzondering in de Ierse privacywet die handelsgeheimen beschermt.


De basis van het inzageverzoek is het recht van inzage, bij ons artikel 35 Wet bescherming persoonsgegevens. Dit recht bepaalt dat iedereen het recht heeft te vragen “of hem betreffende persoonsgegevens worden verwerkt.” Als dat zo is, dan moet de verantwoordelijke daarvoor “een volledig overzicht daarvan in begrijpelijke vorm” verschaffen, met onder meer het doel van de verwerking, de soorten gegevens, de ontvangers (of soorten ontvangers) en alles dat hij heeft over de herkomst van de gegevens. Een flinke bult gegevens, volgens bronnen tot een gigabyte groot.


Lid 4 van dit artikel bepaalt dat men óók moet vertellen op welke manier men gegevens verwerkt:


Desgevraagd doet de verantwoordelijke mededelingen omtrent de logica die ten grondslag ligt aan de geautomatiseerde verwerking van hem betreffende gegevens. 

De beheerder van het bestand mag een verzoek alleen weigeren als het disproportioneel grote  lasten op  zou  leveren. Hij mag bovendien  geen  hoge  administratiekosten  rekenen  – de wet noemt expliciet een bedrag van 5 euro als maximumvergoeding voor het afhandelen van een dergelijk verzoek. Dat er mogelijk een hoop moet worden gekopieerd of uitgetypt, maakt het verzoek nog niet meteen disproportioneel, zo besliste de Hoge Raad in de Dexia-zaak. Daar werd overigens ook bepaald dat het oproepen tot het massaal doen van verzoeken géén misbruik van het recht is. De Privacy Inzage Machine van Bits of Freedom is dus volstrekt legaal (en deze verkapte oproep om ‘m te gebruiken dus ook).


De Ierse wet bevat nog een specifieke uitzondering voor dat “logica”-lid:


Subsection (1) (a) (iv) of this section is not to be regarded as requiring the provision of information as to the logic involved in the taking of a decision if and to the extent only that such provision would adversely affect trade secrets or intellectual property (in particular any copyright protecting computer software).

Deze uitzondering staat bij ons niet in de wet, maar hij is terug te vinden in de privacyrichtlijn, overweging 41, dus in de praktijk mag de rechter deze uitzondering toch toepassen bij ons. 


Men mag dus inzage weigeren in de logica als dat handelsgeheimen in gevaar zou brengen. Daar kan ik me nog wel iets bij voorstellen. Maar het moge duidelijk zijn dat inzage weigeren in persoonsgegevens zelf met een beroep op dit artikel niet kan. Je bent dan misschien het product van Facebook, maar dat product heeft wel het recht te weten wat er precies van hem wordt verkocht en aan wie.

Een aantal van die registraties weet je zonder twijfel wel te noemen, zoals je medisch dossier bij je huisarts en de gegevens over het abonnement van je mobiele telefoon. Misschien heb je wel een idee van wat je telefoonaanbieder vastgelegd heeft, maar je weet het zeker niet van de organisaties waar je niet eens bij stil staat.

En weet je ook precies wat in je medische dossier is vastgelegd? Waarschijnlijk niet. Toch is het meestal niet heel moeilijk om daar achter te komen: je kunt de organisaties er gewoon om vragen.

Je hebt het recht om inzage te krijgen in wat bedrijven over je hebben vastgelegd. Fouten mag je corrigeren en – als de registratie niet nodig is – ook gegevens weer verwijderen. Daar is een wet voor. Een wet die je het recht geeft om te controleren of de registratie van jouw gegevens juist, volledig, relevant en rechtmatig is.

Om het je makkelijker te maken hebben zo’n 15 vrijwilligers van Bits of Freedom de Privacy Inzage Machine (PIM) gebouwd. In drie simpele stappen stel je de brief op waarmee je inzage in jouw gegevens kan vragen. We hebben zo’n 200 bedrijven geselecteerd waar je uit kan kiezen. Nadat je je contactgegevens hebt opgegeven kun je de brief aan de bedrijven uitprinten. Samen met een kopie van je identiteitsbewijs is dat voldoende om inzage te krijgen.]]></description>

    <dc:creator>roel</dc:creator><description><![CDATA[Deze studie laat zien dat het toenemend gebruik van databases in onze gedigitaliseerde samenleving niet zonder risico’s is en dat we lessen moeten trekken uit de ervaringen die daarmee tot nu toe zijn opgedaan.

Databases worden in onze samenleving ingezet voor een groeiend aantal doeleinden. Ze lijken ongekende mogelijkheden te bieden om gegevens op te slaan, uit te wisselen, te bewerken en te analyseren.

Maar dit gebruik van databases is niet zonder risico’s. Hierbij spelen vragen als: voor welke doeleinden worden ze gebruikt, hoe staat het met de beveiliging van gegevens, hoe betrouwbaar zijn die gegevens, welke mogelijkheden hebben burgers om fouten in registraties te herstellen en dragen databases daadwerkelijk bij aan de doelstelling waarvoor ze in het leven zijn geroepen?

Deze studie gaat aan de hand van zes casestudies op deze vragen in. Daarvoor is gekozen voor de volgende actuele onderwerpen:

    de OV-chipkaart en de kilometerheffing
    het elektronisch patiëntendossier
    het elektronisch kinddossier
    klantenprofielen op internet
    het Schengen Informatie Systeem

Nog los van de opnieuw bewezen ineffectiviteit van deze bewaarplicht telecommunicatiegegevens, onder andere omdat slimme criminelen de maatregel makkelijk kunnen omzeilen, vormt de verplichte opslag van de ‘verkeers- en locatiegegevens’ een heftige inbreuk op de privacy van iedere Nederlander. Want de bewaarplicht geldt niet alleen voor verdachten van ernstige criminaliteit, maar voor iedereen – ook voor jou. In Nederland worden je gegevens namelijk zo vaak opgevraagd, dat we koploper zijn in Europa.

Wat kan er dan precies afgeleid worden uit die ‘verkeers- en locatiegegevens’? Vraag het aan politici of ambtenaren en meestal moeten ze je het antwoord schuldig blijven. Een studie (PDF) van het prestigieuze Massachusets Institute of Technology (MIT) geeft een nauwkeurig en ongemakkelijk antwoord op die belangrijke vraag. Lees je even mee wat ‘verkeers- en locatiegegevens’ over jou zeggen?

De bewaarplicht stelt vast wie onze vrienden, collega’s en kennissen zijn, in ieder geval bij 90% van alle Nederlanders. Zo wordt een precies beeld gekregen, van jouw sociale- en werkomgeving. ‘Vervelend’, denk je, ‘maar dat kan misschien ook door op andere manieren?’ Een profiel op een sociaal netwerk komt in de buurt, maar geeft minder details en betreft niet iedere Nederlander – je hebt keuze of je profiel aanmaakt en wat je erop zet.]]></description>
