She was convinced that it could be applied to an equal opportunity of employment in a profession that stipulated no physical limitations other than weight. 'I looked around the racetrack and saw one guy who had worked in a laundromat, another who'd been a plumber, and they were urged to become jockeys just because they were small,' Kusner recalled recently from her home in suburban Los Angeles. 'And I'd already ridden in two Olympic Games.' With attorney Audrey Melbourne by her side – working pro bono for what she called 'a landmark case' – Kusner exhausted the commission process then took her case to a Maryland circuit court. On Sept. 27, 1968, Judge Ernest Loveless ruled in favor of Kusner and ordered the Maryland commission to issue a license."]]></description>

And later she told the Melbourne Herald-Sun: "My intention was to go back to England and ride over there. But I realised there are more opportunities for the girls here, so I changed my plans. I would be happy if I had five rides in a week at home, whereas here I can sometimes have five rides in a day."]]></description>

From the comments, in response to Livingston: "I've been involved in racing for going on 50 years myself, and after reading your post here, I've been thinking a whole lot about how I've been treated on the racetrack over these many years. I'd have a hard time counting all the times I'd been propositioned by trainers, owners, and others on the tracks. Pinned up against tack room walls by a trainer, been kissed by much older male trainers that I never had anything but respect for prior to them behaving so inappropriately with me, and I've quit many good paying jobs due to the discomfort after my experiences of this type had left me with. And ya know, here's something you might find weird ... in all my years in racing, not once had I thought of, or had it occurred to me that this was sexual harassment or anything that I might have gone upstairs and reported to any officials in racing. I had made my position very clear to my offenders of such bad behavior and simply walked away. in some cases, the fallout had ended with my quitting, but in others, it all went away like it'd never been anything more than a mistake, to be forgiven, and I'd not have to think of it again, and didn't. I'm a little bit shocked at my own self for not being more aware, and seeing what has been made so clear to me now, just by reading your post!"]]></description>

I’m thinking mostly of the British Horseracing Authority, which is not naturally sympathetic to the idea but might prick up its ears if it felt the change improved the situation of female jockeys without provoking outrage among the men. But I’d say Britain already has more of a culture of female success in the saddle than France, thanks in large part to Hayley Turner but also to her fellow champion apprentices Josephine Gordon and Amy Ryan. A weight allowance here probably would provoke a faster uptake by trainers and owners, not least because there are quite a few young women around who have already proved they can win, like Hollie Doyle, Jane Elliott, Shelley Birkett, Lulu Stanford and Rachel Richardson. And there seems a ready supply of others who can become like them, 7lb claimers in their late teenage years who appear unpromising at first but get the hang of it after 30, 40 or 50 rides."]]></description>

It also didn't prevent 105-pound Bill Shoemaker from winning four Kentucky Derbies, the last at age 54. 

2. The more likely culprit is persistent gender discrimination. The best evidence comes from a 1995 study which found that, though women won less prize money than men overall, that happened because women didn't get good horses in good races. In fact, women actually won more money than men who rode similar horses in similar races. Women outperformed men with the opportunities they got, but women didn't get the opportunities they deserved.

In an era still suspicious of women as jockeys, Driggers was on a pace of winning more than 50 races a year when she retired in 1984 to marry horseman Hap Proctor, start a family, and eventually move to Ocala, Fla., where they managed the Glen Hill Farm of Leonard Lavin. You would never refer to the fit, feisty Jane Proctor as any kind of matriarch, except for the fact that no one could imagine life without her love of horses and boundless energy lighting up the landscape. Life without Jane Proctor began this week when she died from the ravages of an aggressive, malignant brain tumor. She was 61. The Thoroughbred world is less now for her loss but a better place because she was here."]]></description>

She remembered two male trainers telling her that she had no shot at success unless she came to work as his assistant before going out on her own.

“’You’re not going to get the opportunities unless you work for a trainer like me and I essentially hand them to you,’” she remembered them saying.

In another example, she recalled a jockey’s agent that refused to return her phone calls…until she started winning, and now she hears from him regularly, asking if she’s got anything his client might ride. The answer is always, said Gaudet, “No.”

“It’s comical now,” she said. “But it’s sad that you have to go through that.”]]></description>

She sits still, they run for her and she won some races for me when we didn’t expect she would win. She rides in work in the mornings but I have some other jockeys that I use. I don’t use her in some of the bigger races. We have a lot of South American male jockeys who ride here and do very well. She can’t compare with them yet, but she was the top apprentice here.”

Lindahl said that can be a problem for her and other female jockeys in Sweden.

“It’s hard (for a female jockey) in Sweden, but I think it’s harder in England and Ireland and even here,” she said. “We get quite a lot of chances actually, but in the big races they pick the guys. They think boys are stronger and boys are better.”

The other problem all Swedish jockeys face is that trotting is so popular in the country that Thoroughbred racing can seem almost invisible. The top harness drivers are big stars in the country, on par, even, with the Swedes playing in the NHL. Not so for jockeys.

“It’s strange because Thoroughbred racing is so much more exciting than trotting and so much faster,” Lindahl said. “I guess it is because there has always been a lot of trotting throughout the country. Everyone knows about trotting.”]]></description>
