Nothing could be more misconstrued than actually believing that. No sir, regulation is not really the issue at hand, it's more than likely that the alleged positive test for Medina Spirit would have been called under the upcoming federal statue as well ... I ask you ... do not forget this week. Don't just let the sands of time lessen the anger or disgust or disdain that you felt. If nothing else racing is persistent and while Rombauer's sharp performance in winning the Preakness was a good tonic for the previous weeks ails, don't let the enablers off the hook again. While surely the bombastic sound bites of last week will echo in the ears of some, the real noise which might ultimately doom the game was silence."]]></description>

By definition, this process can result in the lack of uniformity among states for the same model rule. So how much progress has been made on NUMP? Unfortunately for ARCI, the RMTC has been tracking the adoption of the 500 pages of model rules and their adoption in the ARCI Thoroughbred racing state jurisdictions. Racing jurisdictions have allegedly been working on achieving uniformity for over a decade. NUMP was created in 2012, and there is no true industry medication uniformity in sight."]]></description>

Humans sport testing does a very good job of detecting relatively short-acting, small molecule drugs, and so does horse racing. Everyone knows that. Everyone also knows when we are going to test the horses—right after the race. That is pretty easy to plan around if you are bent on cheating. Many of the most effective PEDs are gone well before race day when horses are tested but the performance enhancing effects are still present. The effects of many drugs can last well past the time the drug is still present, or present at detectable levels. Anabolic steroids, beta-2 agonists, and blood doping agents are good examples. And this should be clear to everyone: Races are won in training. That is true in human sport; it is true in horse racing. Just as in human sport, we need to pay more attention to PEDs being used in training and we can only do that by OOCT."]]></description>

Masochistic was tested out of competition because of a participation agreement in a Breeders' Cup challenge race, the Pat O'Brien Stakes at Del Mar. The out-of-competition testing program was paid for by the Breeders' Cup, but there is a California Horse Racing Board Rule, 1842, dealing with horses placed on the vet's list for medication, that reads: 'Any such report is confidential and its content shall not be disclosed except in a proceeding before the stewards or the Board, or in exercise of the Board's jurisdiction.' In addition, California's Veterinary Practice Act protects patient-veterinary confidentiality. So the regulatory board could not communicate to Breeders' Cup the fact a horse tested positive out of competition for a drug that is only prohibited on race day."]]></description>

    <dc:creator>jnchapel</dc:creator><description><![CDATA[Section 15. Use of Riding Crops. (1) Although the use of a riding crop is not required, a jockey who uses a riding crop during a race shall do so only in a manner consistent with exerting his or her best efforts to win.

      (2) In any race in which a jockey will ride without a riding crop, an announcement of that fact shall be made over the public address system.

      (3) An electrical or mechanical device or other expedient designed to increase or retard the speed of a horse, other than a riding crop approved by the stewards, pursuant to 810 KAR 1:012 shall not be possessed by anyone, or applied by anyone to a horse at any time, on the grounds of the association during a race meeting, whether during a race or otherwise.

      (4) A riding crop shall not be used on a two (2) year-old horse in races before April 1 of each year.

      (5) A riding crop shall only be used for safety, correction and encouragement.

      (6) A rider who uses a riding crop shall:

      (a) Show the horse the riding crop and give the horse time to respond before striking the horse;

      (b) Having used the riding crop, give the horse a chance to respond before using it again; and

      (c) Use the riding crop in rhythm with the horse’s stride.

      (7) A riding crop shall not be used to strike a horse:

      (a) On the head, flanks or on any other part of its body other than the shoulders or hind quarters except if necessary to control a horse;

      (b) During the post parade or after the finish of the race except if necessary to control the horse;

      (c) Excessively or brutally;

      (d) Causing welts or breaks in the skin;

      (e) If the horse is clearly out of the race or has obtained its maximum placing; and

      (f) Persistently even though the horse is showing no response under the riding crop.

      (8) A riding crop shall not be used to strike another person.

      (9) After the race, a horse may be subject to inspection by a racing official or official veterinarian looking for cuts, welts or bruises in the skin. Any adverse findings shall be reported to the stewards.

      (10) The giving of instructions by any licensee that if obeyed would lead to a violation of this section may result in disciplinary action also being taken against the licensee who gave the instructions.]]></description>
