"The action by the U.S. District Court for the Eastern District of New York follows an investigation by the U.S. Department of Labor Wage and Hour Division. Investigators found that Danny Gargan and Gargan Stables Corp. paid certain employees at the racetracks, stables and other locations a fee per horse handled and not per hour as stated in their payroll records. In addition to shortchanging workers' hours and unlawfully denying them overtime when they worked more than 40 hours in a workweek, the division determined the employer falsified payroll records to give the appearance that employees were paid by the hour when they were not. The court affirmed the department's assessment of $37,368 in civil money penalties for willful wage theft and for falsifying records in violation of the Fair Labor Standards Act."

He started working in racing and went on the circuit doing most every job on the backside. Through the '60s and '70s, he kept the camera around and, during his travels, would take pictures of the horses he admired and the people who cared for them. Why do you think so many people are drawn to a track, work around it, never leave it? Because they like horses? Aw, come on. Even for those who adore the animals, they are just the raw material, more lovable, perhaps, than the pineapples of Hawaii or the anthracite of West Virginia, but incidental products just the same. It is the community that holds the people. The backside of a racetrack is the most dependable, structured place left on a discombobulated globe. It moves with a cadence all its own, unaffected by geography or dialect or the intrusions of the real world just beyond the gates. It is one of the last set pieces, one where all the people take their assigned places and all the events move inexorably — the way it used to be in real small towns."

1. "The recent spike in COVID-19 cases at Golden Gate Fields has been the largest known coronavirus outbreak at a horse racing track in California this year. In the spring, the Santa Anita Park racetrack near Pasadena — which is also owned by The Stronach Group — identified 38 cases. In July, there were 15 COVID-19 cases at Del Mar Thoroughbred Club north of San Diego."

2. "Backside workers said the scene at Golden Gate Fields last week as the outbreak unfolded was surreal, after everyone had been tested but results were pending. As results came in, it seemed like people were getting picked off one by one. One said it came to feel like a ghost town. 'It wasn't even, "Did anybody get it?" It was like: 'How many people in your barn?' one trainer said."

3. "Hess, who raced horses in the '60s and has been at Golden Gate Fields since 1971, currently has about a dozen horses at the track. He said he wasn't sure how he contracted COVID-19 and dismissed theories about where the racetrack outbreak might have started as 'just conjecture.' Hess also said he thought the track had done a good job with putting safety protocols in place this year." [Hess, 86, died of COVID complications in early December.]

'Some of them are dangerous,' she added. 'It's dangerous enough being out there anyway without some of these other riders that are out there. And there aren't any [riders] to replace them.' The dangers aren't restricted to humans. There's also the cyclical wear-and-tear that bad or inexperienced riders can inflict – the uneven grind on joints from a horse that hangs, or the heavy load on the front legs from an iron-mouthed run-off. The sorts of things that pre-dispose horses to catastrophic injury."

Past that rail and into the public eye, grooms become faceless and voiceless appendages to a bucket and a shank. No - more, maybe even less. Never mind that they spend the most time with the horse, become familiar with his or her personalities, are the first to know when a horse is off its feed, detect before a vet or trainer if something is wrong, and yes, in the vast majority of cases, bond with and even love the horses under their care. A 20-year veteran of the Rhone stable, his P-1 visa — reserved for professional athletes — assured he could work at Canterbury as an exercise rider this season. But his son Alejandro is among many co-workers who needed an H-2B visa, and they had some anxious moments while waiting for their documents to be approved."

3. "Trainers and grooms said there are few undocumented workers at Canterbury Park. The track has a reputation for tough enforcement of immigration law — earned in part by raids conducted during its early years — and Minnesota’s licensing requirements for track workers are considered strict. Applicants are fingerprinted and must undergo criminal background checks."

4. "Trainers are in survival mode right now. Without a workable visa program, it’s going to challenge their ability to stay in business."

Baldemar Bahena's journey toward the American dream started as a teenager on the backside of tracks. When he left Mexico on a visa, he spoke a little English but had a knack with horses.

More than 30 years later, Bahena oversees dozens of workers as Romans' top assistant. Bahena and his wife became U.S. citizens and they settled into a four-bedroom home in Louisville. Their two teenage children are college bound.

"He's a great American success story," Romans said of his friend.

But Bahena, 49, worries the door of opportunity may be closing behind him for other immigrant workers toiling at racetracks in search of a better life for their families.

"They're good people," he said. "They're working hard all the time. They're kind of scared."

Bahena voted for Trump because of the Republican's business background, and said he holds out hope the new president will make things better.

"I tell everybody, just chill out a little bit and I think in another year or something, it'll be all right," he said. "I think he's going to change his mind because he's a real, real good businessman, and he's going to figure it out that these people are good people."

Even for those who qualify for Medicaid or who decide to obtain insurance through the exchanges, there will be co-payments, deductibles and incidental costs that, on the typically low salaries paid at the track, they won’t be able to afford. And for those without a legal immigration status, there won’t be anything at all. So, at a minimum, BEST and CTHF need to keep operating their on-track clinics, and even, to the extent they can afford to, expand the range of services offered at those clinics to include more medical tests and more specialist services. And they need to help backstretch workers take advantage of the expanded care available under the Affordable Care Act, by providing help in enrolling for Medicaid, for those eligible, and in navigating the online insurance exchanges that are being set up."

"It’s not hard to see why racetracks would contemplate getting rid of their stabling areas or pressing horsemen to foot part of the bill. Backstretches at many racetracks can occupy a hundred acres of valuable land ripe for redevelopment. In addition, there are huge costs associated with maintaining a backstretch, running from the expense of providing security to complying with increasingly strict EPA regulations over manure removal and water run-off. Barn maintenance and repair, keeping a track in shape for year-round training, and providing housing to backstretch workers employed by trainers ..."

"One way veterinarians can facilitate change and promote ethical behavior is by charging for services, rather than only for dispensing medication -- a common practice among racetrack veterinarians. Such a change eliminates the perception that a veterinarian is simply out to sell a medication without regard for its necessity.... The public perception of medication use in racing is another big challenge practitioners face, Blea said, noting a Thoroughbred trainer once said that a good veterinarian with ethics is not going to do very well in racetrack practice. Blea said he takes exception to this trainer's opinion but also recognizes that ethical questions remain among the toughest to address."

But the guest worker program is capped at 66,000 non-agricultural unskilled workers a year for all sectors nationally. For fiscal year 2011, which began in October, more than 35,600 petitions for spots have already been filed. The number of applications routinely bumps up against the number allowed, leaving employers scrambling for labor sources."
