The US attorney’s office in Washington has requested that a federal appeals judge overturn convictions for members of far-right groups Proud Boys and the Oath Keepers, who had been found guilty of seditious conspiracy over January 2021 Capitol Hill riots.

The members of the groups were granted clemency by US President Donald Trump early into his second term. However, while 12 Proud Boys and Oath Keepers were released from federal prisons, they did not receive a full presidential pardon, unlike nearly 1,500 other people convicted in connection with the riot.

At the time, the US president did not provide any rationale for not pardoning the members of the groups, which has been widely perceived as politically risky. Multiple civil rights organizations, including the Jewish advocacy Anti-Defamation League (ADL), consider Proud Boys and Oath Keepers to be far-right extremists.

The members of the groups, including Stewart Rhodes, the founder of the Oath Keepers militia, who received the second-longest prison sentence (18 years) among all the January 6 defendants, have repeatedly complained about the lack of a full pardon. They had challenged their convictions in a court of appeals, and the deadline for filing court papers had been approaching.

The Colorado Court of Appeals upheld her conviction and said she is ineligible for a pardon by President Donald Trump. However, it ruled that she was improperly sentenced and sent the case back to state court for resentencing.

“Here, the trial court’s comments about Peters’s belief in the existence of 2020 election fraud went beyond relevant considerations for her sentencing,” the court’s April 2 opinion says.
“Her offense was not her belief, however misguided the trial court deemed it to be, in the existence of such election fraud; it was her deceitful actions in her attempt to gather evidence of such fraud.”

In 2021, Mesa County Clerk and Recorder Tina Peters told her staff that Gerald Wood was a new government administrative assistant. But Wood was not a government worker; he was part of a team of private citizens concerned about election fraud.

Peters then obtained security credentials for him to witness the state’s upcoming election software update, which occurred about every other year.]]></description>

In a sharply worded, 15-page ruling issued Monday, Cannon blasted Smith for what she called a “brazen stratagem,” accusing him of pressing ahead with the report even after she ruled in July 2024 that his appointment as special counsel was unconstitutional and dismissed the case against Trump and two co-defendants.

“Special Counsel Smith and his team went ahead for months, undeterred, preparing [the classified documents report] using discovery collected in connection with this proceeding and expending government funds in the process,” Cannon wrote. “To say this chronology represents, at a minimum, a concerning breach of the spirit of the Dismissal Order is an understatement, if not an outright violation of it.”

Cannon said releasing the report now would “contravene basic notions of fairness and justice” and amount to a “manifest injustice,” noting the case never reached a jury. She also warned publication could expose information shielded by attorney-client privilege and grand jury secrecy.

“While it is true that former special counsels have released final reports at the conclusion of their work,” Cannon wrote, “it appears they have done so either after electing not to bring charges at all or after adjudications of guilt by plea or trial. Before joining the Goldwater Institute, Jon served on active duty in the U.S. Navy Judge Advocate General’s (JAG) Corps, representing hundreds of service members and litigating dozens of court-martial cases. While in law school, he clerked for Senator Jon Kyl on the U.S. Senate Judiciary Committee, on the Arizona State Senate Rules Committee, and in the Office of Counsel to the President at the White House.

Jon holds a B.A. from Boston College, where he graduated magna cum laude and was inducted into Phi Beta Kappa. He earned his J.D. from the University of Arizona’s James E. Rogers College of Law.

He currently serves as an officer in the U.S. Navy Reserve and is an adjunct professor at Arizona State University’s Sandra Day O’Connor College of Law. He was previously appointed by the President to serve as a member of the Federal Service Impasses Panel from 2017-2020.  He is also a member of the Federalist Society’s Regulatory Transparency Project, where he serves on the State and Local Working Group.

In December 2022, he planned to sell his property to a buyer who desired the property’s available uses in that commercial zone. But the city of Holbrook interfered when it enacted a new ordinance that removed an existing property use for the hotel. The ordinance was passed by the city council in order to restrict what businesses can operate in Holbrook. This left Anil without a buyer, and the value of his property decreased.

Arizona’s Private Property Rights Protection Act (also known as Prop 207) was enacted to ensure that property owners are fairly compensated when government regulations decrease the value of private property. Under Prop 207, if a property owner’s right to use their land is restricted by a land use law, and that reduces the fair market value of the property, owners are entitled to just compensation.

That is why the Goldwater Institute filed a lawsuit against the city of Holbrook demanding the just compensation Anil is entitled to for the city’s restriction of his property rights.]]></description>

Lai, a strident critic of the Chinese Communist Party (CCP), was sentenced to 20 years in prison for two counts of “conspiracy to collude with foreign forces” under the national security law, as well as a count of printing seditious materials under a colonial-era law.
The ruling was delivered on Feb. 9 by three national security judges, handpicked by the city’s pro-Beijing government. Lai had denied all charges.

The sentence represents the harshest punishment to date under the security law, surpassing the previous record of a 10-year jail term handed down by Hong Kong’s High Court to Benny Tai, a legal scholar and pro-democracy campaigner, in 2024.
Lai, who suffers from diabetes and heart palpitations, has already been kept behind bars for five years and two months in Hong Kong. He now has 28 days to appeal the court ruling.

U.S. Secretary of State Marco Rubio called on the Hong Kong authorities to grant Lai humanitarian parole.]]></description>

I represent Sherrie Hanna—a life-long Prescott resident, a Republican, and one of three finalists interviewed to fill a vacant council seat at a special meeting on May 20, 2025. The vacancy existed because Councilmember Cathey Rusing resigned to run for Mayor. It is an interest in real property established by agreement between a landowner and land trust or unit of government. The conservation easement "runs with the land", meaning it is applicable to both present and future owners of the land. The grant of conservation easement, as with any real property interest, is part of the chain of title for the property and is normally recorded in local land records.

The conservation easement's purposes will vary depending on the character of the particular property, the goals of the land trust or government unit, and the needs of the landowners.     <dc:creator>icresource</dc:creator><description><![CDATA[The Federal Communications Commission (FCC) cannot and should not change its rules to allow for the uncontrolled proliferation of new cell towers and other wireless infrastructures, according to comments filed Dec. 31, 2025, with the FCC by Children’s Health Defense (CHD).

On Sept. 9, 2025, the FCC proposed new rules aimed at “eliminating barriers to wireless deployments” by silencing local communities. The rules target communities that attempt to resist efforts by telecom companies to build new cell towers next to homes and schools.

According to CHD, the proposed new rules are a “misguided” distraction from the FCC’s clear legal responsibility to comply with a 2021 court mandate that the agency explain how its wireless radiation safety limits protect human health.

W. Scott McCollough, lead litigator for CHD’s Electromagnetic Radiation (EMR) & Wireless cases, who filed the comments on behalf of CHD, told The Defender in an email, “What the FCC *must* do is tend to the 2021 DC Circuit Court’s remand requiring them to address health and environmental effects.”

On Aug. 13, 2021, the U.S. Court of Appeals for the District of Columbia Circuit ruled the FCC failed to consider the non-cancer evidence of adverse health effects related to wireless technology when the agency determined its radiofrequency (RF) radiation safety limits adequately protected public health. The agency hadn’t updated the safety limits since 1996.

The ruling stemmed from CHD’s win in a case consolidated with the Environmental Health Trust, which also challenged the FCC’s decision not to update the 1996 limits.

The District of Columbia Circuit panel majority told the FCC it must do a better job of explaining how its 1996 limits adequately protected public health, and remanded the case back to the FCC. The ruling required the FCC to reopen its investigation into the agency’s RF radiation exposure limits to verify that they are adequately protecting people’s health.

Despite these clear prohibitions, the Forest Service collects fees from all drivers who park their vehicles in a mile-wide piece of the Coronado National Forest running along the 28–mile Catalina Highway, the only paved road to the summit of Mount Lemmon, a heavily used recreational area an hour's drive from downtown Tucson, Arizona.

Four recreational visitors sued,1 seeking a declaration that the Forest Service was exceeding the scope of its authority under the REA by charging fees to those who drive to Mount Lemmon, park their cars, then picnic, hike, or camp in nearby undeveloped areas. Plaintiffs also sought to enjoin the Forest Service from collecting such fees. The district court granted defendants' Rule 12(b)(6) motion to dismiss. Plaintiffs appealed. Because plaintiffs are correct that the Forest Service's fee structure contravenes the plain language of the REA, we reverse the district court's dismissal of Count I2 and remand to allow plaintiffs to pursue that claim.

Four hikers, including two from Ojai, filed a lawsuit in late 2012 challenging the U.S. Forest Service’s right to charge visitor fees at Los Padres, Angeles, San Bernardino and Cleveland national forests.

Senior U.S. District Court Judge Terry J. Hatter Jr. on Monday agreed that the fee, called an Adventure Pass, cannot be levied if people use the forests but not amenities such as campgrounds.

Adventure Passes are $5 for a day or $30 for a year.

“If all a person wants to do is park and have a picnic or go for a hike or camping or backpacking, they do not have to pay a fee,” said Matt Kenna, the hikers’ Colorado-based attorney. “Now if you go and use a developed campground then you will have to pay a fee, as you should.”]]></description>

Such boats have absolutely no national or international protections, and you cannot commit a war crime against them.

A vessel in international waters is required under UNCLOS to sail under the flag of a specific nation. If it does not, it is legally considered a stateless vessel. A stateless vessel has no right to the protections normally afforded to ships under a national flag, including immunity from interference by other states.

UNCLOS Articles 92, 94, 110, and customary maritime law spell out the consequences clearly:

1. Stateless vessels have no sovereign protection. A flagged ship is an extension of its flag-state’s sovereignty. A stateless vessel is not. This matters because “war crimes” presuppose protected persons or protected property. A stateless vessel is legally unprotected.

2. Any state may stop, board, search, seize, or disable, a stateless vessel. UNCLOS Article 110 explicitly authorizes boarding and seizure. The law does not require states to risk their own personnel or assets while doing so. Disabling a vessel that refuses inspection, including firing on it, is legally permitted under both UNCLOS and long-established state practice.

3. War crimes require an armed conflict. You cannot commit a “war crime” outside an armed conflict. War crimes occur only within the context of international humanitarian law (IHL). Enforcing maritime law against a stateless vessel is a law enforcement action, not an IHL situation.

On Thursday, the Harju District Court sentenced Aivo Peterson, co-founder of the small conservative Koos (Together) party, to 14 years in prison for treason. His associates Dmitri Rootsi and Andrei Andronov received sentences of 11 years and 11 years and six months, respectively. All three denied any wrongdoing and said they would appeal the verdict.

Prosecutors alleged that the defendants spread “narratives supporting Russia’s foreign and security policy” intended to undermine public trust in NATO and Estonia’s military aid to Ukraine.

According to the Indictment, beginning in at least 2016, Dickerson served as the Executive Director of Black Lives Matter OKC (BLM OKC). As Executive Director, Dickerson had access to BLM OKC’s bank, PayPal, and Cash App accounts.

While BLM OKC was not a registered tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, the organization allegedly accepted charitable donations through its affiliation with the Arizona-based Alliance for Global Justice (AFGJ). FGJ served as a fiscal sponsor to BLM OKC and required the BLM group to use its funds only as permitted by Section 501(c)(3).

AFGJ also required BLM OKC to “fully account upon request for the disbursement of all funds received and prohibited BLMOKC from using its funds to purchase real estate without AFGJ’s consent,” prosecutors said.]]></description>

“This proclamation ends a grave national injustice perpetrated upon the American people following the 2020 Presidential Election and continues the process of national reconciliation,” the document states.

The pardon would only cover federal charges brought against those listed. The proclamation also explicitly states that the pardon does not apply to Trump.]]></description>

States have typically relied on the counting of illegal immigrants to apportion congressional districts, which are set aside for approximately 765,000 Americans per district per decade, according to NBC News. The Census also plays a role in the distribution of all-important Electoral College votes for presidential elections.

On Truth Social, Trump said he has instructed the U.S. Commerce Department to begin outlining how to conduct this decade’s second census since its last one was completed in 2021.

“I have instructed our Department of Commerce to immediately begin work on a new and highly accurate CENSUS based on modern day facts and figures and, importantly, using the results and information gained from the Presidential Election of 2024,” he wrote.

The organization, which has long been funded by some of the Democratic Party’s biggest donors, has racked up more than $15 million in legal fees over the last several months in order to defend itself against several lawsuits, according to a report from the New York Times. Among the entities pursuing legal action against Media Matters include the Federal Trade Commission, a number of state attorneys general and Elon Musk.

As a result, the group has been forced to reduce the size of its staff, documents and 11 people familiar with the matter informed The Times. Executives have also been scrambling to raise cash from increasingly skeptical donors.

Elon Musk’s X corp filed a lawsuit against Media Matters in the U.S. District Court for the Northern District of Texas back in November of 2023. The suit claims that the left-wing group defamed X by publishing a report alleging that advertisements from major brands, such as Apple, IBM, and Oracle, appeared next to pro-Nazi and antisemitic content on the platform.

X alleges that Media Matters “knowingly and maliciously” manipulated its algorithm by using test accounts that followed specific users and repeatedly refreshed feeds to generate images of ads next to extremist content, misrepresenting the typical user experience.

“This case carries with it the weight of fierce scientific and policy debates about the safety, efficacy, and propriety of medical treatments in an evolving field. The voices in these debates raise sincere concerns; the implications for all are profound,” Chief Justice John Roberts wrote for the majority. “The Equal Protection Clause does not resolve these disagreements. In her dissent, Justice Sonia Sotomayor wrote that the decision “abandons transgender children and their families to political whims.”

The ruling comes as states wrestle with the complexities of accommodating transgender residents while respecting the rights of parents and conservatives who oppose granting minors the ability to pursue life-altering medical procedures. The debate has played out over bathroom accommodates, women’s sports, and federal funding.

Increasingly, the U.S. is on an island compared to global approaches toward transgender procedures for minors. Last month the U.K.’s top court ruled that transgender women, or biological men, can be excluded from participating in certain groups or gender-exclusive facilities such as locker rooms and homeless shelters. Trans activists cast the decision as an affront to their civil rights.]]></description>

Martin, who most recently served as interim U.S. Attorney for the District of Columbia, pointed to former President Biden’s use of autopen as a point of concern during a press conference Tuesday.

An autopen is an electromechanical device designed to replicate a person’s signature with precision. It can be used by high-ranking officials, including U.S. presidents, to sign large volumes of documents without requiring their direct involvement. While it is legally recognized in certain cases, its use in signing critical legal documents—especially without clear oversight—has prompted questions about authenticity and accountability.

According to a report from the Oversight Project, an arm of the Heritage Foundation, every document bearing Biden’s signature—except for the letter announcing his withdrawal from the 2024 race—appears to have been signed by an autopen. The findings have put a spotlight on Biden’s cognitive state and whether unelected officials were making decisions on his behalf.

“I do think that the Biden pardons need some scrutiny. And they need scrutiny because we want pardons to matter and to be accepted and to be something that’s used correctly. So I do think we’re going to take a hard look at how they went and what they did,” Martin told ABC News during Tuesday’s press conference.

“If they’re null and void, I’m not sure how that operates, but I can tell you we’ve had already, I’ve had in my current position, or my position as US Attorney, we had been taking a look at some of the conduct surrounding the pardons and the Biden White House,” he said.]]></description>

In Washington, U.S. District Judge James Boasberg has suggested that in order for the administration to avoid being held in criminal contempt, it should reassert custody over at least some of those deported individuals. Meanwhile, Paula Xinis, a federal judge in Maryland, has similarly indicated that the administration could be held in contempt for not facilitating the return of one of those detainees, Kilmar Abrego Garcia, to the United States.

Earlier this month, the Supreme Court also intervened in a Texas case by temporarily halting President Donald Trump’s deportations of a group of individuals in the state under the Alien Enemies Act. The 18th-century law has been invoked only a handful of times in and around wartime.

While the president has historically been understood to be in charge of foreign affairs, Congress has some input through treaties. Under Article III of the Constitution, the judiciary’s power is focused on the cases and controversies brought before it.

According to the administration, both judges have grossly overstepped their authority.

“Foreign affairs cannot operate on judicial timelines,” the Department of Justice told Xinis earlier this month.

The criminal referral came from Federal Housing Finance Agency (FHFA) Director William Pulte, who outlined the allegations in a letter addressed to Attorney General Pam Bondi and Deputy Attorney General Todd Blanche. The letter, which was reviewed by Fox News and the New York Post, alleged that James had “falsified records” to get home loans for a property in Virginia. James had listed the property as her “principal residence” in 2023 despite serving as the attorney general of New York.

The letter further revealed that James previously purchased a Brooklyn home in 2001, but has “consistently misrepresented the same property as only having four units in both building permit applications and numerous mortgage documents and applications,” the letter noted. This could have allowed James to receive a lower mortgage rate and led to lower payments under the federal Home Affordable Modification Program (HAMP).

“Ms. James, for both properties listed above, appears to have falsified records in order to meet certain lending requirements and receive favorable loan terms,” Pulte wrote.

The alleged criminal act occurred just weeks before James began her civil fraud trial against the Trump Administration, which was accused of undervaluing a number of properties, resulting in a $454 million judgement.]]></description>

City of New London shocked the nation when it rubber-stamped a decision by state officials to seize private homes by eminent domain to make way for private redevelopment projects. In response, lawmakers on both sides of the political aisle began passing new state laws aimed at protecting property owners from government takings.

Despite these efforts at reform, governments have found plenty of loopholes allowing them to abuse property owners by condemning land or by changing the rules that govern how owners can use their property, sticking them with the mortgage, the taxes, the potential liability if someone slips and falls on the property—and often wiping out the property’s market value. Ten years after Kelo, most federal and state courts still do little to protect landowners when government declares their property “blighted” or takes away the right to use property as one wishes.

In response to the rampant abuses that remain even in the wake of post-Kelo reforms, the Goldwater Institute has developed a cutting-edge initiative to limit government’s power to seize land outright through eminent domain or through the more insidious method of overregulation. The Act1 (1) ensures that government can only condemn private property for truly public uses, not to help out developers or advance political agendas, and (2) requires government to pay owners when its regulations reduce their property values without actually ensuring public health and safety. The Act is a principled, practical solution that strikes a fair balance: it allows government to bar property uses that threaten public health or safety, but it also bars officials from sticking property owners with the bill when land-use restrictions go beyond what’s necessary to protect the public.]]></description>

    <dc:creator>icresource</dc:creator><description><![CDATA[Phoenix—Responding to the growing popularity of “sharing economy” internet rental services like Airbnb and VRBO that connect vacationers with short-term home rentals, some of America’s most-popular tourist destinations—including some in Arizona—are banning or severely restricting private short-term rentals. Today Arizona Governor Doug Ducey signed a law that stops local governments from turning responsible property owners into outlaws simply because they allow paying guests to stay in their homes.

In Arizona, Jerome, Sedona, and Scottsdale have either banned vacation rentals or severely restricted them. SB 1350, sponsored by Sen. Debbie Lesko and passed with overwhelming bipartisan support, is the first law of its kind in the country and ensures property use restrictions are limited to true health and safety concerns.

“This law is a huge win for property owners statewide. Gone are the days when you could face jail time and thousands in fines for renting out your house to tourists,” said Christina Sandefur, the executive vice president of the Goldwater Institute and author of the model bill that SB 1350 was based on.

The Goldwater Institute has represented homeowners whose rights to use their property as a vacation rental have been taken away or restricted. One of those homeowners is Glenn Odegard, who purchased a dilapidated home in Jerome, Ariz., with the purpose of turning it into a vacation rental. Town officials gave him building permits, and even a business permit, to restore the former historic home. After Glenn spent hundreds of thousands restoring the home to its former glory, town officials changed their minds and said he could no longer use the home as a vacation rental. The Institute took Jerome to court to protect Glenn and dozens of other Jerome homeowners with vacation rentals.

This new law puts an end to that lawsuit and protects Glenn and future homeowners that want to use their homes as vacation rentals.

“Arizona has a long tradition of protecting private property rights. This new law brings that tradition into the 21st Century by protecting homeowners who want to take advantage of new technologies and platforms to earn a living or supplement their incomes,” said Sandefur. “In combination with Arizona’s law that protects homeowners against eminent domain and regulatory takings, this law makes Arizona, without a doubt, the most property-rights-friendly state in the union.”

During the waning days of New York City Mayor Bill de Blasio’s administration, the city council approved a law which would have granted municipal voting rights to more than 800,000 newly arrived denizens. Neither he or Mayor Eric Adams chose to veto the law, and it was automatically enacted in 2022.

Since then, the fight over illegal immigrant voters in New York has centered on the state’s constitution, which stipulates that only U.S. citizens over the age of 18 are allowed to vote, and that nothing about the autonomy of local government can change that. The fight was spearheaded by Joe Borelli, the former Republican minority leader of the New York City Council who was a plaintiff in the successful lawsuit.

“We file some lawsuits that are stretches,” he told Politico after the state Court of Appeals ruled 6-1 in the opponents’ favor. “This one was, from the beginning, an open-shut case.”

The decision saw nearly all of the court’s progressive members side with their conservative and moderate counterparts to poke legal holes in a law that ran up against the constitutional phrase “every citizen shall be entitled to vote at every election for all officers elected by the people.”

Opponents of the New York law argued this line prohibited noncitizens and illegal immigrants from voting, while Democrats and progressive voter advocacy organizations contended it should be seen as a “floor” for voter access, not a ceiling, and that local governments have the power to expand voter access if they wish.

“Under that interpretation, municipalities are free to enact legislation that would enable anyone to vote – including … thirteen-year-old children,” Chief Judge Rowan Wilson wrote for the majority.]]></description>

    <dc:creator>icresource</dc:creator><description><![CDATA[The resistance movement is alive and well in the halls of Democratic state attorneys general, many of whom recently formed an unofficial “pact” to sue or otherwise slow down every part of President Donald Trump’s agenda.

A plan to counter the Trump administration’s sweeping reforms to illegal immigration, specifically the elimination of birthright citizenship as a constitutional guarantee, has been outlined in a document obtained by the Heritage Foundation. The conservative think tank revealed that 23 attorneys general spanning 22 states and the District of Columbia have formed a “secret pact” to mount an all-out effort to block the termination of birthright citizenship after President Trump signed a related executive order.

The foundation’s Oversight project wrote on X that the plan has been in place and was “signed beginning on November 8, 2024.”

“This agreement, just 3 days after President Trump’s landslide election win, shows that these resistance actors began, as a matter of absolute urgent top priority, plotting their resistance to President Trump’s anticipated actions to end birthright citizenship,” the post read. “Their top priority was not gas, groceries, public safety, or any other matter of concerns of their citizen constituents, but instead a raw political calculus to ensure that the future children of the illegal aliens that entered during the Biden Border Crisis could turn into voters.”

Written as a legal “common interest agreement,” all parties agree to help propagate “potential litigation to challenge executive action related to ending or curtailing birthright citizenship,” according to the Western Journal.]]></description>

Kelly pointed out that Democrats have filed “40 lawsuits so far” with the intent to obstruct Trump’s executive authority. “The Democrats think they’ve found the speed bump they’ve been looking for,” she said.

Many of these cases, she noted, rely on obtaining temporary restraining orders that prevent Trump from implementing his policies until full hearings can be held.

“They’re winning temporary restraining orders to say, ‘You can’t enforce that law until we have a full hearing on it,’” Kelly said. “And they’re like, ‘Oh, it’s a huge win, we’re shutting down Trump’s ability to change the government.’”

Kelly dismissed the idea that these legal maneuvers constitute major victories for Democrats, describing the process as overblown. “There’s literally only one example of [Trump] being ordered to resume payments to federal agencies where then the plaintiff said he didn’t resume doing that fast enough,” she explained.

However, Kelly noted that Trump’s legal team responded appropriately by outlining the payments being made and clarifying the situation to the court. Democrats and media figures have repeatedly claimed that Trump’s defiance of certain court orders amounts to a “constitutional crisis.”

However, Kelly argued that Trump has not refused to comply with any court ruling, nor has he “flipped the bird to any judge.” Instead, she contended that the executive branch retains significant control over federal spending and that many of the current lawsuits against Trump will be overturned.]]></description>

According to the OMB memo, which was rescinded on Wednesday following a bipartisan political backlash, federal agencies were required to pause “all activities related to obligation or disbursement of all Federal financial assistance, and other relevant agency activities that may be implicated by the executive orders.” Though this memo is no longer in effect, the executive orders it sought to enforce still are.

The theory that the president can simply cut off federal spending that has been appropriated by Congress is known as “impoundment,” and has long been considered unconstitutional by judges and legal scholars across the political spectrum.
