The US attorney’s office in Washington has requested that a federal appeals judge overturn convictions for members of far-right groups Proud Boys and the Oath Keepers, who had been found guilty of seditious conspiracy over January 2021 Capitol Hill riots.

The members of the groups were granted clemency by US President Donald Trump early into his second term. However, while 12 Proud Boys and Oath Keepers were released from federal prisons, they did not receive a full presidential pardon, unlike nearly 1,500 other people convicted in connection with the riot.

At the time, the US president did not provide any rationale for not pardoning the members of the groups, which has been widely perceived as politically risky. Multiple civil rights organizations, including the Jewish advocacy Anti-Defamation League (ADL), consider Proud Boys and Oath Keepers to be far-right extremists.

The members of the groups, including Stewart Rhodes, the founder of the Oath Keepers militia, who received the second-longest prison sentence (18 years) among all the January 6 defendants, have repeatedly complained about the lack of a full pardon. They had challenged their convictions in a court of appeals, and the deadline for filing court papers had been approaching.

“Pray that the United States Supreme Court allows our country to continue its unprecedented march toward unparalleled greatness!” he wrote in all caps in a Jan. 6 post on Truth Social.
Treasury Secretary Scott Bessent has said that the government could invoke other authorities to implement tariffs, although they are “not as efficient, not as powerful.”

In December 2022, he planned to sell his property to a buyer who desired the property’s available uses in that commercial zone. But the city of Holbrook interfered when it enacted a new ordinance that removed an existing property use for the hotel. The ordinance was passed by the city council in order to restrict what businesses can operate in Holbrook. This left Anil without a buyer, and the value of his property decreased.

Arizona’s Private Property Rights Protection Act (also known as Prop 207) was enacted to ensure that property owners are fairly compensated when government regulations decrease the value of private property. Under Prop 207, if a property owner’s right to use their land is restricted by a land use law, and that reduces the fair market value of the property, owners are entitled to just compensation.

That is why the Goldwater Institute filed a lawsuit against the city of Holbrook demanding the just compensation Anil is entitled to for the city’s restriction of his property rights.]]></description>

    <dc:creator>icresource</dc:creator><description><![CDATA[The Federal Lands Recreation Enhancement Act (“REA”) prohibits the United States Forest Service from charging fees “[s]olely for parking, undesignated parking, or picnicking along roads or trailsides,” for “hiking through ․ without using the facilities and services,” and “[f]or camping at undeveloped sites․” 16 U.S.C. § 6802(d)(1)(A), (D) & (E). Despite these clear prohibitions, the Forest Service collects fees from all drivers who park their vehicles in a mile-wide piece of the Coronado National Forest running along the 28–mile Catalina Highway, the only paved road to the summit of Mount Lemmon, a heavily used recreational area an hour's drive from downtown Tucson, Arizona.

Four recreational visitors sued,1 seeking a declaration that the Forest Service was exceeding the scope of its authority under the REA by charging fees to those who drive to Mount Lemmon, park their cars, then picnic, hike, or camp in nearby undeveloped areas. Plaintiffs also sought to enjoin the Forest Service from collecting such fees. The district court granted defendants' Rule 12(b)(6) motion to dismiss. Plaintiffs appealed. Because plaintiffs are correct that the Forest Service's fee structure contravenes the plain language of the REA, we reverse the district court's dismissal of Count I2 and remand to allow plaintiffs to pursue that claim.

Four hikers, including two from Ojai, filed a lawsuit in late 2012 challenging the U.S. Forest Service’s right to charge visitor fees at Los Padres, Angeles, San Bernardino and Cleveland national forests.

Senior U.S. District Court Judge Terry J. Hatter Jr. on Monday agreed that the fee, called an Adventure Pass, cannot be levied if people use the forests but not amenities such as campgrounds.

Adventure Passes are $5 for a day or $30 for a year.

“If all a person wants to do is park and have a picnic or go for a hike or camping or backpacking, they do not have to pay a fee,” said Matt Kenna, the hikers’ Colorado-based attorney. “Now if you go and use a developed campground then you will have to pay a fee, as you should.”]]></description>

Such boats have absolutely no national or international protections, and you cannot commit a war crime against them.

A vessel in international waters is required under UNCLOS to sail under the flag of a specific nation. If it does not, it is legally considered a stateless vessel. A stateless vessel has no right to the protections normally afforded to ships under a national flag, including immunity from interference by other states.

UNCLOS Articles 92, 94, 110, and customary maritime law spell out the consequences clearly:

1. Stateless vessels have no sovereign protection. A flagged ship is an extension of its flag-state’s sovereignty. A stateless vessel is not. This matters because “war crimes” presuppose protected persons or protected property. A stateless vessel is legally unprotected.

2. Any state may stop, board, search, seize, or disable, a stateless vessel. UNCLOS Article 110 explicitly authorizes boarding and seizure. The law does not require states to risk their own personnel or assets while doing so. Disabling a vessel that refuses inspection, including firing on it, is legally permitted under both UNCLOS and long-established state practice.

3. War crimes require an armed conflict. You cannot commit a “war crime” outside an armed conflict. War crimes occur only within the context of international humanitarian law (IHL). Enforcing maritime law against a stateless vessel is a law enforcement action, not an IHL situation.

In one of the greatest environmental turnarounds in history, China has added more than 500,000 km² of forest since 1990. In 2022 it pledged to plant, conserve, restore, and manage 70 billion trees by 2032—a cornerstone of the global ‘1 Trillion Trees’ initiative to supercharge carbon sinks and biodiversity.

In 2024 alone:
• 4.45 million hectares of new trees planted
• 3.22 million hectares of grassland restored
• 2.78 million hectares reclaimed from desert

That pushed national forest cover past 25% (up from ~12% in the 1980s) blasting past the 2025 target of 24.1% ahead of schedule. Cumulative restoration since 2012 now exceeds 70 million hectares. 

Meanwhile, humanity has destroyed more than half the world’s original native forests—mostly for agriculture. Today’s forests still cover ~31% of global land (the vast Taiga being the biggest survivor) but the Amazon tells a far darker story: 17–26 % already gone.  Meanwhile the proxy (Ukraine) has lost half its pre-war population, most of its industry, and virtually 40% of its 1991 territory east of the Dnieper.

This is not a draw. This is annihilation dressed up as “strategic stalemate” by people who can no longer afford their own electricity bills.]]></description>

First a federal district court and then the 2nd U.S. Circuit Court of Appeals ruled against the Amish families.

But the Supreme Court told the appeals court Monday to give the case a new look in light of last term’s ruling in a case challenging the lack of parental opt-outs to the LGBTQ diversity curriculum in Montgomery County, Maryland.

A proclamation document shared by Martin on social media named more than 70 individuals, including former New York City Mayor Rudy Giuliani, former White House Chief of Staff Mark Meadows, and attorneys Sidney Powell and John Eastman, all accused of involvement in Trump’s bid to challenge the 2020 election results.
The pardons apply to conduct tied to the individuals’ involvement in activities surrounding the 2020 presidential election, as well as any conduct related to “their efforts to expose voting fraud and vulnerabilities in the 2020 Presidential Election,” according to the document.

“This proclamation ends a grave national injustice perpetrated upon the American people following the 2020 Presidential Election and continues the process of national reconciliation,” the document states.

The pardon would only cover federal charges brought against those listed. The proclamation also explicitly states that the pardon does not apply to Trump.]]></description>

In a 6-3 decision, the high court signaled that all states may now pursue bans on transgender-related care for minors, a deeply unpopular policy, but one which galvanized far-left progressive activists in the 2024 election. Another 26 states have already put in place laws similar to the one challenged in Tennessee.

“This case carries with it the weight of fierce scientific and policy debates about the safety, efficacy, and propriety of medical treatments in an evolving field. The voices in these debates raise sincere concerns; the implications for all are profound,” Chief Justice John Roberts wrote for the majority. “The Equal Protection Clause does not resolve these disagreements. Nor does it afford us license to decide them as we see best.”

In her dissent, Justice Sonia Sotomayor wrote that the decision “abandons transgender children and their families to political whims.”

The ruling comes as states wrestle with the complexities of accommodating transgender residents while respecting the rights of parents and conservatives who oppose granting minors the ability to pursue life-altering medical procedures. The debate has played out over bathroom accommodates, women’s sports, and federal funding.

Increasingly, the U.S. is on an island compared to global approaches toward transgender procedures for minors. Last month the U.K.’s top court ruled that transgender women, or biological men, can be excluded from participating in certain groups or gender-exclusive facilities such as locker rooms and homeless shelters. Trans activists cast the decision as an affront to their civil rights.]]></description>

The case arises from a challenge to Trump’s birthright citizenship executive order. The hearing is unusual in that it stems from a preliminary appeal in which the Trump administration challenged a federal judge’s use of nationwide injunctions to block the president’s agenda.

The Trump administration argues that district court judges are exceeding their authority by imposing broad blocks on government policy rather than applying them to the parties in the lawsuits. Three lower court judges have issued nationwide injunctions blocking Trump’s policy of ending birthright citizenship for children of illegal immigrants.
With more than 100 lawsuits against Trump’s policies, lower court judges have issued a raft of nationwide injunctions halting parts of the administration’s agenda, from federal spending freezes to immigration enforcement to the cancellation of diversity, equity, and inclusion programs.

The injunctions are highly controversial because they impose policy changes for the entire country rather than offering relief only for plaintiffs in the lawsuits, drawing scrutiny from some Supreme Court justices and members of Congress.

The U.S. Court of Appeals for the D.C. Circuit on Saturday granted a stay on a lower court’s order that had mandated the reinstatement of over 1,000 Voice of America (VOA) employees who had been let go by the Trump Administration, which has moved to largely gut United States Agency for Global Media (USAGM). A lower court judge had previously ordered the reinstatement of all employees and a full return to previous VOA operating standards.

“This is a huge victory for President Trump and his Article II powers granted in the United States Constitution. It’s also a victory for US Agency for Global Media (USAGM) and VOA,” Kari Lake, who has been serving as a senior advisor to the USAGM for the Trump Administration, told Fox News after Saturday’s ruling was handed down.

“In less than 100 days, thousands of illegal aliens have used the CBP Home app to self-deport,” DHS Deputy Secretary Tricia McLaughlin told The Epoch Times via email on April 22.

McLaughlin said that illegal immigrants still residing in the country must immediately use the CBP Home app to leave the country, or they will face penalties.

“This includes a fine of $998 per day for every day that the illegal alien overstayed their final deportation order,” McLaughlin added.

The Trump administration announced on March 3 that it made available the CBP Home app for those who came into the country via the CBP One app and were unable to legalize their immigration status.

The CBP Home app is an update of the CBP One app, which the Biden administration used since January 2023 for U.S.-bound migrants to schedule appointments with immigration officials and apply for temporary asylum before they enter the United States.
Meanwhile, Tom Homan, President Donald Trump’s designated border czar, told reporters at the White House on April 23 that over the past three months, approximately 68,000 illegal immigrants have been arrested.

“And we’re going to continue, despite what the district court says,” Homan said, referring to ongoing legal battles surrounding Trump’s deportation orders.

On April 8, DHS also revoked the legal status of some of the more than 900,000 people who were allowed to enter the United States with the CBP One app, according to a CBP report.

”Under federal law, Secretary Noem—in support of the President—has full authority to revoke parole,” a DHS spokesperson told The Epoch Times in an email. “Canceling these paroles is a promise kept to the American people to secure our borders and protect national security.”

In Washington, U.S. District Judge James Boasberg has suggested that in order for the administration to avoid being held in criminal contempt, it should reassert custody over at least some of those deported individuals. Meanwhile, Paula Xinis, a federal judge in Maryland, has similarly indicated that the administration could be held in contempt for not facilitating the return of one of those detainees, Kilmar Abrego Garcia, to the United States.

Earlier this month, the Supreme Court also intervened in a Texas case by temporarily halting President Donald Trump’s deportations of a group of individuals in the state under the Alien Enemies Act. The 18th-century law has been invoked only a handful of times in and around wartime.

While the president has historically been understood to be in charge of foreign affairs, Congress has some input through treaties. Under Article III of the Constitution, the judiciary’s power is focused on the cases and controversies brought before it.

According to the administration, both judges have grossly overstepped their authority.

“Foreign affairs cannot operate on judicial timelines,” the Department of Justice told Xinis earlier this month.

The cases have already reached the Supreme Court and will likely come before the justices again, resulting in potentially landmark decisions on the nation’s separation of powers.]]></description>

However, Kelly noted that Trump’s legal team responded appropriately by outlining the payments being made and clarifying the situation to the court. Democrats and media figures have repeatedly claimed that Trump’s defiance of certain court orders amounts to a “constitutional crisis.”

However, Kelly argued that Trump has not refused to comply with any court ruling, nor has he “flipped the bird to any judge.” Instead, she contended that the executive branch retains significant control over federal spending and that many of the current lawsuits against Trump will be overturned.]]></description>

Speaking at a press conference, Bondi made it clear that the new DOJ is taking action to protect American citizens, specifically highlighting the devastating impact of illegal immigration on families across the country.

“We’re here today because we have filed charges against the state of New York. We have filed charges against Kathy Hochul. We have filed charges against Letitia James and Mark Schroeder, who is with DMV,” Bondi stated. “This is a new DOJ, and we are taking steps to protect Americans.”

The lawsuit comes amid growing outrage over New York’s sanctuary policies, which Bondi and federal prosecutors argue have placed American lives in danger. The case was brought forward in part due to Tammy Nobles, the mother of a young woman who was brutally murdered by an MS-13 gang member from El Salvador.

Nobles, standing alongside Bondi at the press conference, shared her tragic story, detailing how New York’s refusal to cooperate with federal immigration authorities allowed her daughter’s killer to remain in the country.

According to the OMB memo, which was rescinded on Wednesday following a bipartisan political backlash, federal agencies were required to pause “all activities related to obligation or disbursement of all Federal financial assistance, and other relevant agency activities that may be implicated by the executive orders.” Though this memo is no longer in effect, the executive orders it sought to enforce still are.

The theory that the president can simply cut off federal spending that has been appropriated by Congress is known as “impoundment,” and has long been considered unconstitutional by judges and legal scholars across the political spectrum.

If you’ve been following this case for a while, you know what I’m talking about. This was the moment you’d dream of in your quiet, private moments, but could never fully allow yourself to believe would actually happen.

It was very easy to imagine Assange dying in a prison cell, either in the near future at Belmarsh or further along the timeline in some US hellhole. It was possible to imagine him getting out many years from now, his children fully grown and half his life stolen away from him. It was even possible to imagine him getting out one day on some legal technicality or whatever and living out the rest of his life in a nation that has an oppositional relationship with Washington like Edward Snowden, maybe. But coming home, to Australia?? No chance.

I discussed the concept of natural-born citizens in an Epoch Times essay last year. I explained that being a natural-born citizen requires more than merely being a citizen. The additional requirements depend largely on the allegiance of one’s father.
You may have your own ideas of what “natural-born citizen” should mean. But that essay summarized the standards prescribed by the Constitution.

One of the rules is that a person born in U.S. territory whose father is rightfully in this country is natural born. If our Japanese tourist couple has a baby here, the child is a natural-born American. For the other rules, see last year’s essay.
Birthright Citizen

Birthright citizenship is the idea that children born in the United States of foreign parents are natural-born American citizens. The child born in America to the Japanese tourist couple is a birthright citizen.
But our Japanese tourist couple was in the country legally. Does birthright citizenship apply to the children of foreigners in the country illegally? Many people assume the answer is “yes.” That’s why some foreign women sneak across the border while pregnant to give birth in U.S. territory. They think their child will automatically be an American citizen. Agents of the U.S. government often operate on the same assumption. I recently did a search with the “Brave” internet browser, and my search produced the flat statement that the assumption is true.
