1. You created a plugin as work-for-hire for a client, and there was a contract that had you signing over the copyright to the said client. In this case, if your client decides to use the plugin only for his or her website, GPL is not triggered. Thus, if the client (the copyright owner) decides not to distribute the software, the software is not distributable. No one can forcibly copy the plugin and cite GPL as a valid excuse. If however, your client releases or distributes the plugin, GPL comes into play.

2. You created a plugin for a client, but the contract did not state signing over of the copyright. In this case, you remain the holder of the copyright, and thus your selling of the plugin to your client automatically counts as a distribution (and more technically, not as work-for-hire). GPL is in effect, even though your client may or may not further pass on the plugin.]]></description>

Yet, copyrights also raise the cost of accessing existing work – potentially discouraging future innovation.This paper uses an exogenous shift towards weak copyrights(and low access costs) during WWII to examine the potentially adverse effects of copyrights on science. Using two alternative identification strategies, we show that weaker copyrights encouraged the creation of follow-on science, measured by citations.This change is driven by a reduction in access costs, allowing scientists at less affluent institutions to use existing knowledge in new follow-on research.]]></description>

For example, the sqrt() method could always return zero - indeed, every method that returns a number could always return zero, while those that return text could always return the letter "a", those that return true or false could always return true, and so on, with a default result being used for every variable type.

This set of APIs would serve no useful purpose, but would have exactly the same structure, selection and organization as the Oracle APIs. No reasonable jury could ever conclude that the “expression” in this hypothetical set of APIs is substantially similar to the “expression” in the Oracle APIs, notwithstanding the “copied” structure, selection and organization.

On this basis and the careful copyrights in each document, I am unwillingly led to conclude that the jury might not deliver good news when it returns from its deliberations. Of course, I deeply hope I'm wrong.

However, a silver lining could present itself: The jury could affirm that the APIs are copyrighted but that the syntax of the function signatures are a fair use exception. The big content companies are TERRIBLE at doing both of these things, so it’s no wonder they’re not doing so well in the current environment. And right now everyone’s fighting to control distribution channels, which is why I can’t watch Star Wars on Netflix or iTunes. It’s fine if you want to have that fight, but don’t yell and scream about how you’re losing business to piracy when your stuff isn’t even available in the box I have on top of my TV.
