Readability’s approach may feel like extortion to publishers who don’t like the idea of people altering their content or consuming it in other ways — but the reality is that this is happening all the time, whether the media industry likes it or not. It might be the Huffington Post aggregating your stories, or it might be Flipboard or Zite giving people a different way of seeing it, or it might be Instapaper. At least Readability is trying to help publishers monetize that content in some way, by giving them a revenue share when they register with the service, as Clay Johnson points out. Is that an incentive to sign up? Sure it is. But at a time when content companies are trying everything they can to figure out how to monetize what they produce — whether it’s paywalls or apps or other subscription models — why not take advantage of a service that at least some readers have already shown they want, and are willing to pay for? Either that, or come up with your own version of Readability and compete.

Fear-Induced Foolishness: Entertainment Industry Thinks Controls On New TLDs Will Actually Impact Piracy | Techdirt

Last month, we wrote about how the RIAA was backing a version of the .music top level domain that would only allow "accredited" musicians to get domains with a .music suffix. Their key concern, as always, was that .music would be used for infringement. It appears that it's not just the RIAA who's concerned, and not just about .music. Paul Keating points us to the news that various other legacy entertainment industry groups, including the MPAA, ASCAP and others, have joined with the RIAA to warn of the horrors that await if .music, .movies and .games are allowed without special anti-piracy features.

(...)

But, here's the thing: all that stuff already happens on other domains. What difference does it make if it happens on those new domains? It's not like domains are a totally scarce resource, and stopping piracy on one particular TLD will somehow prevent infringement. This just seems like a strange and pointless battle. It's not actually fighting infringement. It's fighting the possibility that a certain domain will be used for infringement -- even though preventing that won't stop any infringement at all, since it will continue on other websites. So why even spend time focusing on something so useless? It says something about the mindset of these organizations that they can't comprehend that making a stand over this is completely meaningless. They just instinctively lash out at anything new.

That's the amazing thing about so many anti-piracy attempts. They simply don't take into account the actual situation, and what the real costs and benefits of their actions are. They just think "piracy bad, must stop." They refuse to accept that those who are infringing may have reasons for doing so beyond "I'll never give any money to these people ever." Not actually understanding that seems like a huge strategic blunder. For all the talk of having an "obligation" to sue fans, I would think that the company's officers actually have an obligation to the company's shareholders, which means not making braindead moves that actually hurt the bottom line. And yet that seems to be the ultimate plan here.

I think we can add to this "huh?" discussion: the new effort from Fox, in which the studio will be putting up giant murals in malls to try to make it "easier" for you to buy DVDs. Here's how it works according to Deadline.com:

As part of an exclusive one-year partnership with Twentieth Century Fox Home Entertainment, the malls will have a wall with cover art and QR codes for many the studio’s home videos. People who want to buy the movie or TV show can download a smartphone app called Fox Movie Mall, available for both iPhones and Android devices. It will enable them to scan an image and go directly to a Web site to complete the purchase for a DVD or Blu-ray disc shipped free to their home.

So, yeah. You go to a mall (physical) and download a special app (digital) which you then use to scan a silly QR code (digital) to be sent to a website (digital) to order a DVD (physical) to be shipped to your home (physical). There are a bunch of ridiculous extra steps here and I can't figure out how any of this makes sense. If you havepeople ina mall already and you're trying to get people to buy physical product, why not just let them scan and pick up the physical product? If you're focusing on the digital components, why require a specialized app that no one's going to want to download, and then not offer a digital version of the film?

The most common question I get about MIME is, "have you ever imagined what it would be like if you got a penny every time MIME was used?" And the answer is oh yeah, I imagined that (laughs). I did some checking up, and there's an estimate that MIME is used a trillion times every day. So if I got a penny every time, my annual income would be roughly equal to the GDPofGermany. But of course, that's just a silly fantasy. If there was any money involved, it would never have succeeded. Somebody would have been motivated to develop a similar thing for free.

This is the attitude of a true innovator. Borensteindeveloped MIME because he saw a problem that he wanted to solve—and he knew his solution wouldn't be of much use to anyone if he demanded an ongoing monopoly on it. Contrast that with trolls who obtain patents on abstract ideas and demand a cut from companies that are actually implementing them, and you see why the very nature of technology patents is opposed to their stated goal of promoting innovation.

"The Cheezburger Network attempted to copyright the rage faces last year, and that was met with a lot of resistance, so they dropped it," Swanson added. "There are smaller retail websites that have rage face stickers and bumper stickers, and those have been greeted pretty well, but when a bigger corporate entity tried to commodify them it has been greeted with resistance." Hot Topic's "Rage Meme T-Shirt" Know Your Meme

In Awesome's view, this resistance is a result of the most basic tenet of rage comics: the community ownership of the individual characters, which are freely copied, pasted, and reused in countless comics.

"The faces don't really 'belong' to anybody, especially not the corporations," Awesome said. "Not everybody is aware of this almost unspoken ideology. It's okay to make yourself a 'Cereal Guy' shirt, but it's not okay to see a 'Cereal Guy' shirt being sold at Old Navy." In short, the rage face community wants its community creations to stay in the wild where they can grow and evolve.

American manga publishers learned their lessons early on. In 2008, Yaoi Press founder Yamila Abraham—an early proponent of digital distribution—worked with a company called Fika Publishing to create apps for their comics, which feature male-male relationships. “They knew Apple had tight policies so we first attempted to get our tamest title accepted, Zesty,” Abraham told me in an e-mail this week. “There is no gay sex in Zesty. The gayest thing is two guys kissing. The School Library Journal even rated it grades 10 and up,” she said. “Apple flat out rejected it and refused to tell us why so we could modify it for a resubmission. To me it said they aren’t anti-porn, they’re anti-gay. I was extremely bitter over this.” Given Apple’s track record, most manga publishers haven’t even tried. Of yuri publisher ALC Publishing, founder Erica Friedman says, “… we have not ever considered releasing any ALC Publishing books by iTunes. When we last published a book, Apple wasn’t the monster distributor it is now—print was still the favored distribution. Right now, I am so enraged and disgusted by Apple’s censorship—especially of LGBTQ material—that I do not consider them a viable distributor of our material.”

The anonymity of the web gives companies and governments golden opportunities to run astroturf operations: fake grassroots campaigns that create the impression that large numbers of people are demanding or opposing particular policies. This deception is most likely to occur where the interests of companies or governments come into conflict with the interests of the public.

One of the things I've never liked about copyright is its potential to be the functional equivalent of censorship. Sometimes this censorship comes about because an author didn't get permission to create his work in the first place (see: Richard Prince, JD California). While this unfortunately turns judges into cultural gatekeepers, it's been deemed a necessary balance between copyright law and the First Amendment, and harm to the public is arguably lessened by the fact that we don't know what we're missing; because the censored work is never able to reach and impact us, we've only lost the potential of its cultural contribution. However, other times a work is created with the initial blessing of copyright, makes its mark on the public, then becomes effectively censored down the line due to licensing restrictions (see: The Wonder Years, Werewolf). This is much more culturally pernicious because it deprives the public of a work already in its lexicon, and the sense of loss is far more palpable as a result. Often, the only way to get the work back in the public's hands is to perform triage, excise the no-longer-licensed content, and try to be happy with a bastardized version of the work (see: WKRP in Cincinnati, The State). What's interesting, however, is how we've seen the Internet step up to effectuate cultural preservation, when copyright law stands in the way.

This is a remarkably naïve notion of how audiences work. Or, rather, it’s third person effects in operation, wherein one’s own reaction to an item of media is trusted to be sophisticated, whereas a worried-about other’s is not. Here, women are imagined to be that third person (itself posting the normative “us” as men), and to be a simpler audience, one whose hormones and feminine frailty lead to having more reliably passive, simplistic, and easily-engineered responses to media.

People deal with the disconnect by saying one thing, "Creativity is good, we want more of it!" but actually rejecting creative ideas for being impractical.

And, the more uncertain people feel, the harder they find it to recognise a truly creative idea. So as a society we end up sticking our heads in the sand and carrying on doing the same old things we've been doing all along, just to avoid feeling uncertain.

Instead we should be embracing uncertainty because it's only when we're unsure that we can be sure we're in new territory.

Based on our analysis of seven large nations, we find that in most countries, every week customers have to wait before they can buy a DVD translates into, on average, 1.8 percent lower DVD sales. Given that good-quality pirated versions are available close to 14 weeks before the legal versions, the losses can be in the millions of dollars. Not surprisingly, a 14-week delay also translates to a 70 percent increase in pirated movie downloads in those countries.

Still, the point is pretty clear: Google and the other search engines don't really drive that much traffic to the Pirate Bay (or other so-called "rogue sites"), and an awful lot of the traffic they do drive... is people searching for TPB itself (meaning they're just using Google as a shortcut, rather than to "discover" infringing works). And, when Google does drive people to specific content, it's usually because the person is already looking for what's almost certain to be an unauthorized version. Thus, the picture the industry paints of people doing innocent searches for authorized content, and somehow being waylaid by Google pointing them to TPB just isn't seen in the data. At all.

As ebook sales mushroom, the Big Six's insistence on DRM has proven to be a hideous mistake. Rather than reducing piracy[*], it has locked customers in Amazon's walled garden, which in turn increases Amazon's leverage over publishers. And unlike pirated copies (which don't automatically represent lost sales) Amazon is a direct revenue threat because Amazon are have no qualms about squeezing their suppliers — or trying to poach authors for their "direct" publishing channel by offering initially favourable terms. (Which will doubtless get a lot less favourable once the monopoly is secured ...)

If the big six began selling ebooks without DRM, readers would at least be able to buy from other retailers and read their ebooks on whatever platform they wanted, thus eroding Amazon's monopoly position. But it's not clear that the folks in the boardrooms are agile enough to recognize the tar pit they've fallen into ...

[*] It doesn't reduce piracy; if you poke around bittorrent you'll find plenty of DRM-cracked ebooks — including all of my titles. DRM is snake oil; ultimately the reader has to be able to read whatever they bought, which means shipping a decryption key along with the encrypted file. And once they've got the key, someone will figure out how to use it to unlock the book.

These proposals harm Internet users' rights of privacy, due process and freedom of expression, as well as endanger the future of the free and open Internet. Global Chokepoints is designed to provide empirical information to digital activists and policymakers and to help coordinate international opposition to attempts to cut off free expression through misguided copyright laws and transnational agreements, like the Anti Counterfeiting Trade Agreement (ACTA).

Global Chokepoints will document the escalating global efforts to turn Internet intermediaries into chokepoints for online free expression. Internet intermediaries all over the world—from Internet Service Providers (ISPs) to community-driven sites like Twitter and YouTube to online payment processors—are increasingly facing demands by IP rightsholders and governments to remove, filter, or block allegedly infringing or illegal content, as well as to collect and disclose their users' personal data.

Yeah, but why should I doubt fandom's ability to create value[2]? On reflection, I think it's another round of the great craft pricing debate -- especially the part where the non-professionals have trouble believing that it is fair to charge for their time. Materials cost, sure. But women's time has been so often devalued that often it's not just the customers who believe that most of the value in a quilt is in the materials and the rest is in the pattern. Compared to previous modes of accessing music, music in the cloud allows other entities remote control over a user’s library and makes music dependent on the service in question. While music has always relied on the technologies of its production, distribution and consumption, music in the cloud is a highly technologized vision of music. It is a specific snapshot of music as a cultural commodity, one that sees music as indelibly networked to certain providers and technologies.

Tom McCourt and Patrick Burkart (2006) argue the shift towards music in the cloud is part of a concerted effort towards organized technocratic control over digital music. They worry major record labels and technology companies are creating a “celestial jukebox” that will ultimately put “new and enduring constraints on music’s viability as a cultural practice protected from pure market functionality”

Basically, the feminist bloggers were seated too far from the fashion models, and consequently no one got their hackles up enough to make it fun. And it must have been doubly frustrating for the ladies to have their debate framed most succinctly and effectively by famous, penis-having audience member Seth Green. Seth’s point was that the Sexy Grrl Geek Debate is actually part of a larger debate about fan authenticity in general, and I couldn’t agree more.

Nobody who likes that silly vampire movie New Moon, full of sparkly otherworldly creatures, would ever be sophisticated enough to like the silly space movie Avatar, full of sparkly otherworldly creatures.

Imagine if this New Moon panel were replaced by a panel devoted to a new Star Wars movie. Would people be screaming about all those "fanatical" Star Wars fans who would undoubtedly line up all night long just to get a glimpse of George Lucas and pals? Would there be complaining that Star Wars fans were taking up space and driving out all the "normal people" who came to see Alice and A Christmas Carol? Would people be suggesting that the Star Wars panel should be moved to another place, or another day? No. Because Star Wars fans, even though they are more fanatical than Twilight fans, are mostly boys. And therefore they are tolerated as "normal people" at Comic-Con while hordes of girl fans are not.

I suggested another possible interpretation: The in/out of box dichotomy is a wonderful analogy to consider two very distinct models of fandom. The first is one deeply embedded in questions of capital and what is considered valuable, more focused on collecting and curating (in this case, action figures, but I think we could extend this fairly easily to canonical data of a media text/franchise) than creating. The second proposes that fandom is steeped in a sense of play (either textual or ideological, or both), and intimately tied to its transformative potential.

Increasingly, we live in an “out of the box” mediascape, in which we expect to be able to play freely with the toys/texts we’ve invested in, emotionally and financially. The media industry might be slowly acknowledging these desires and demands, but on the whole I think they harbor anxieties that letting fans play with their toys/IP

To quote The Bullfinch Guide to Art History, “In contrast to fine art, folk art is primarily utilitarian and decorative rather than purely aesthetic.” Isn’t that what our “everyday” photos are?

The idea that the development of software was less important (and less masculine), than the development of hardware persisted for many years and women continued to work as computer programmers.

In 1967, despite the optimistic tone of Cosmopolitan’s “Computer Girls” article, the programming profession was already becoming masculinized. Male computer programmers sought to increase the prestige of their field, through creating professional associations, through erecting educational requirements for programming careers, and through discouraging the hiring of women. Increasingly, computer industry ad campaigns linked women staffers to human error and inefficiency.

According to Ensmenger, a second type of test, the personality profile, was even more slanted to male applicants. Based on a series of preference questions, these tests sought to indentify job applicants who were the ideal programming “type.” According to test developers, successful programmers had most of the same personality traits as other white-collar professionals. The important distinction, however, was that programmers displayed “disinterest in people” and that they disliked “activities involving close personal interaction.” It is these personality profiles, says Ensmenger, that originated our modern stereotype of the anti-social computer geek.

Greg Kumparak said that whenever he tells folks about services like Spotify and Rdio, he gets wide-eyed glares of disbelief and a pledge to sign up immediately. Why? Because piracy is hard. Ripping CDs is hard. Digging through torrents is difficult. It doesn’t make any sense for anyone over the age of, say, 22, to be digging through The Pirate Bay to find an REM discography. Sure it’s easy to find if you know where to look, but why not just type “REM” into a music service and spend the rest of the day rocking out?

So what happened between 2009 and now? Well, many of these services expanded beyond the desktop to the smartphone, allowing you to listen to music on almost any device. I, personally, listen to Rdio on two laptops, a desktop, two iPhones, and a Sonos system (not all at once). I have no desire to sync all of those machines to one static library any more than I want to download every single new release that comes down the pike. A $9.99 per month streaming service makes a lot of sense, especially for folks who don’t want to futz much with files.
